TERMS AND CONDITIONS OF SALE

1. Seller Identification

These conditions govern the purchase of products from the Guiverno Records online store:

2. Purpose and Products

Guiverno Records is an independent record label selling limited cassette editions (black metal and dungeon synth) and associated merchandise.

Relevant product characteristics:

  • Limited editions: each release has a fixed run. Once sold out, it is not reprinted. The number of copies is indicated on each product page.
  • Pre-orders: some releases are sold via pre-order before their publication date. Payment is made at the time of reservation and shipping occurs from the indicated release date. If the date is delayed, the customer will be informed by email.
  • Condition: unless otherwise stated, all products are new and sealed.

The images on the product pages are illustrative; the actual product may vary slightly in print nuances.

3. Purchase Process

  1. The customer adds products to the cart and completes the purchase.
  2. The total price including VAT (for shipments within the EU) and shipping costs calculated according to the destination are displayed.
  3. Payment is made through the enabled gateway (card / Shopify Payments / PayPal).
  4. Once payment is confirmed, the customer receives an order confirmation email and, subsequently, an email with the tracking number when the order is shipped.

By completing the purchase, the customer declares to be of legal age and that the provided data is correct.

4. Prices

  • Prices are shown in the selected currency and include applicable taxes (VAT) for shipments within the European Union.
  • For shipments outside the EU, prices may be shown without VAT, and the customer will be responsible for any potential customs duties or import taxes in the destination country.
  • Guiverno Records reserves the right to modify prices at any time, without affecting already confirmed and paid orders.

5. Payments

  • Card (Visa, Mastercard, etc.) via Shopify Payments.
  • PayPal (subject to availability).
  • Guiverno Records does not have access to full card details; payment is processed securely by the gateway.

6. Shipping and Delivery

Shipping conditions (carrier, times, costs, and zones) are detailed in the Shipping Policy, which forms part of these conditions. The estimated delivery time is indicated during the purchase process and in the confirmation email.

Product risk: the risk of loss or damage to the product is transferred to the customer at the time of delivery. If the package arrives damaged, it must be reported within a maximum of 48 hours from receipt (see Shipping Policy).

7. Right of Withdrawal

In accordance with Article 102 of Royal Legislative Decree 1/2007 (TRLGDCU), consumer customers have a period of 14 calendar days from receipt of the order to withdraw from the purchase without stating a reason, with the exceptions set forth in the Returns Policy (including the exclusion of sealed products that have been opened, such as sealed cassettes).

8. Legal Guarantee

Products have the 2-year legal guarantee provided for in Article 114 of the TRLGDCU. If a product is found to be defective or non-compliant, the customer has the right to repair, replacement, price reduction, or contract termination, under legal terms.

To exercise the guarantee: write to info@guivernorecords.com indicating the order number and describing the defect.

9. Intellectual Property

Recordings, cover art, and edition designs belong to their authors and the label. The purchase of the physical medium does not grant any rights over the works (reproduction, digital distribution, etc.).

10. Liability

Guiverno Records will only be liable for damages directly resulting from the breach of these conditions and within the limits provided by law. We are not liable for damages caused by unforeseen events, force majeure, or improper use of the product.

12. Applicable Law

These conditions are governed by Spanish law. For disputes with consumers, the court of the consumer's domicile will have jurisdiction.
